Durban — Road-rage murder accused Anthony Edward Ball, 67, will appear in the Pinetown Regional Court on Monday.

Ball allegedly killed Dean Charnley, 49, in a road-rage incident in March 2022 on Everton Road in Kloof.

Ball, who is out on R4 000 bail, handed himself over to police after the incident.

The post-mortem report, crime scene photo album, a ballistics report as well as statements were among the state’s evidence collected in investigations.

Investigations into this matter last year were wrapped up and the case was transferred to one of the regional courts for trial proceedings to begin.

At the time of the alleged shooting, police had said that they arrived on the scene to find a 49-year-old man with gunshot wounds to the chest.

Ball was granted R4 000 bail on March 22, 2022, when he first appeared in court following his arrest on March 19, 2022, after handing himself over to police.

During his bail bid he had told the court how after operating a well-known filling station, Bulwer Park Filling Station, for 35 years he retired.

In support of this application for bail at that time said he had had no prior dealings with the deceased in the matter prior to the incident which gave rise to the alleged murder charge.

According to Charnley’s family he had been with his 18-year-old son who had been seated in the car when he was shot and killed.

He had been on the M25 and had stepped out the car, which had been bought by his eldest son, and had gone unarmed to confront Ball who allegedly wind his window down and shot Charnley.

In a separate court matter Felizwe Cele, 62, made a brief appearance in the Pinetown Magistrate's Court on Friday in connection with the murder of Lungisa Kunene.

Cele is out on R2 000 bail.

Cele allegedly hit him with a wooden stick on the head on November 25, 2022.

Cele, a widower, was arrested four days after the alleged murder.

In court, the State indicated that the post-mortem report as well as witness statements had been filed.

“The crime scene photo album is outstanding,” said State prosecutor Nomcebo Xulu.

The widower with six children who was released on R2 000 bail at the beginning of December intends on pleading not guilty to the charge levelled against him.

The matter was adjourned until February.
