Gauteng Hawks Head Ebrahim Kadwa, senior Crime Intelligence officer Major-General Feroz Khan, and businessman Tariq Downes have briefly appeared in the Kempton Park Magistrate’s Court, where they were granted R20 000 bail each.
The trio was arrested in connection with a 2021 case involving Downes’ alleged unlawful handling of raw precious metals, with Kadwa and Khan accused of defeating the ends of justice.
The State did not oppose bail but requested specific bail conditions for the two senior police officials.
NPA spokesperson Kaizer Kganyago said prosecutors are confident they have a strong case against the accused.
“The accused are charged with two counts, which is basically contravention of the Precious Metals Act, specifically Section 4, as well as defeating the ends of justice,” Kganyago said.
He said the decision to prosecute was made after investigators submitted evidence for assessment.
“Once we have made the decision to prosecute, which is the case here, then people will be arrested and appear before court. We are really comfortable that we have got a case and they have a case to answer.”
Kganyago said the prosecution is preparing to submit the necessary documents when the matter returns to court on 14 July.
“We are working very well with the police, and we are comfortable that we will do that without fear, favour or prejudice,” he said.
